Terms of Service

These Terms govern your access to and use of KanisaManager. By creating an account or using our platform, you agree to these terms and conditions.

1. Acceptance of these Terms

Welcome to KanisaManager. These Terms of Service govern your access to and use of the KanisaManager website, web application, mobile applications, APIs and all related services(collectively, the "Service"). The Service is provided by KanisaManager ("we," "us," or "our")

By creating an account, registering a church, purchasing a subscription, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you should not access or use KanisaManager.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use KanisaManager.

If you create an account or subscribe on behalf of a church, ministry, parish, diocese, denomination, organization, or any other legal entity ("Church"), you represent and warrant that you have the authority to bind that organization to these Terms. The Church is responsible for ensuring that all authorized users comply with these Terms.

3. About KanisaManager

KanisaManager is a cloud-based Church Management System (ChMS) built specifically for churches across Africa. Our platform enables churches to manage members, families, attendance, church services, financial records, events, communication, reports, and other administrative operations from a single secure platform. Depending on your subscription plan, the Service may include features such as:

Member and Family Management
Attendance Tracking
Financial Management
Tithes and Offerings
Event Scheduling
SMS Communication
Email Notifications
M-Pesa Integration
Reports and Analytics
Multi-user Administration
Role-based Permissions
Data Exports
Audit logs
Future premium features introduced by KanisaManager

We may improve, modify, suspend, or discontinue certain features from time to time to improve the Service as we evolve.

4. Church Accounts and User Roles

. 3. Church Accounts and User Roles Every church registered on KanisaManager operates within its own secure workspace. Churches may invite multiple users and assign permissions based on organizational responsibilities. Available roles may include, but are not limited to:

  • Administrator
  • Secretary
  • Pastor
  • Read-only User

Church administrators are solely responsible for creating user-roled accounts, assigning permissions, removing staff members, and ensuring that each user only has access necessary for their responsibilities. You are responsible for maintaining the confidentiality of your login credentials and for all activities performed under your account. If you suspect unauthorized access, you must notify us immediately so appropriate security measures can be taken.

5. Subscription Plans, Billing and Payments

KanisaManager offers subscription-based access to its platform. Pricing may vary depending on the selected plan, number of users, available modules, SMS usage, and additional services. Payments may include:

Monthly subscriptions
Staff activation fees
SMS credit purchases
Premium feature purchases
Custom implementation or onboarding fees where applicable

Payments are processed through Safaricom M-Pesa. Subscriptions automatically renew unless cancelled before the renewal date. Unless otherwise required by applicable law, subscription fees, activation fees, SMS credits, onboarding charges, and other payments are non-refundable once the associated services have been provisioned.

6. Staff Activation and User Licensing

Certain subscription plans require individual staff activation licenses. Access to protected administrative functions may only be granted after the applicable activation fee has been successfully paid. Churches are responsible for ensuring that licenses are assigned only to authorized personnel. Licenses may not be shared simultaneously among multiple users unless expressly permitted under the selected subscription plan.

7. Church Data Ownership

Your church retains full ownership of all information entered into KanisaManager, including but not limited to member records, family relationships, attendance history, financial records, church schedules, announcements, uploaded documents, reports, and communications.

By using the Service, you grant KanisaManager a limited, non-exclusive license to store, process, secure, transmit, back up, and display this information solely for the purpose of providing and improving the Service. We do not claim ownership of your church data.

8. Acceptable Use

To maintain a secure and reliable platform for all churches, you agree not to misuse the Service. You agree not to use KanisaManager to engage in unlawful activities, distribute malicious software, interfere with platform security, attempt unauthorized access, overload our systems, reverse engineer the software, scrape proprietary content, impersonate another individual or organization, or distribute spam, hate speech, abusive material, or fraudulent communications through the platform.

Churches must also ensure that financial records entered into the system accurately reflect their internal records. Deliberately falsifying financial information for deceptive purposes is prohibited. Violation of these Terms may result in suspension or permanent termination of accounts.

9. Financial Records Disclaimer

KanisaManager provides tools for recording offerings, tithes, pledges, donations, expenses, budgets, and other financial activities. Although the platform performs calculations and generates reports based on submitted data, KanisaManager is not an accounting firm and does not provide accounting, tax, auditing, or legal services.

Financial reports generated by the Service are only as accurate as the information entered by church users. Churches remain solely responsible for verifying financial records before relying on them for audits, tax filings, regulatory compliance, or official reporting.

10. Communications

KanisaManager allows churches to communicate with members through SMS, notifications, and other communication tools. Churches are solely responsible for the content they distribute through the platform. Messages must comply with applicable laws and must not contain fraudulent, abusive, defamatory, discriminatory, or unlawful material.

Additional charges may apply for SMS messages based on purchased SMS credits.

11. Third-Party Services

The Service integrates with trusted third-party providers to deliver various features. These providers may include authentication services such as Google SSO, payment providers such as Safaricom M-Pesa, SMS providers , analytics providers, mapping services, and other technology partners.

Your use of these services through KanisaManager may also be subject to the respective terms and privacy policies of those providers.

12. Intellectual Property

KanisaManager, including its software, source code, interface design, branding, logos, graphics, databases, reports, algorithms, documentation, and other proprietary materials, is protected by copyright, trademark, and intellectual property laws.

Subject to these Terms, we grant churches a limited, non-exclusive, non-transferable, revocable license to use the Service for their internal church administration. No part of the Service may be copied, modified, resold, redistributed, reverse engineered, or commercially exploited without our prior written permission.

13. Availability of Service

While we strive to maintain continuous availability, we cannot guarantee uninterrupted operation of the Service. Scheduled maintenance, infrastructure upgrades, security updates, internet outages, and events beyond our control may occasionally affect availability.

We reserve the right to temporarily suspend access for maintenance or emergency security purposes.

14. Data Backups and Disaster Recovery

KanisaManager performs regular backups of platform data to improve service resilience. Although we take reasonable precautions to protect church information, no backup system can guarantee complete protection against every possible event.

Churches are encouraged to periodically export important financial records and member information for their own archival purposes.

15. Termination

Churches may terminate their accounts at any time. We reserve the right to suspend or terminate accounts immediately if users violate these Terms, engage in fraudulent activities, fail to pay outstanding subscription fees, compromise platform security, or use the Service in a manner that negatively impacts other users.

Upon termination, access to the Service will cease. Subject to applicable law and our data retention policies, churches may request an export of their eligible data within the applicable retention period.

16. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, KanisaManager disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, reliability, or error-free operation.

17. Limitation of Liability

To the maximum extent permitted by applicable law, KanisaManager, its directors, employees, contractors, affiliates, and partners shall not be liable for indirect, incidental, consequential, punitive, or special damages, including loss of profits, business interruption, data loss, reputational damage, or financial losses arising from the use or inability to use the Service.

Our total liability arising from any claim relating to the Service shall not exceed the total subscription fees paid by your church during the twelve (12) months immediately preceding the event giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless KanisaManager, its officers, employees, contractors, affiliates, and partners from any claims, liabilities, damages, costs, and expenses arising from your use of the Service, your violation of these Terms, or your infringement of the rights of another person or organization.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya unless otherwise required by applicable law.

Any disputes arising from these Terms shall first be resolved through good-faith negotiations. Where resolution cannot be reached, the dispute shall be submitted to the competent courts of Kenya.

20. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, technology, legal requirements, or business practices.

Where material changes are made, we will notify users through the Service, by email, or through other appropriate communication channels. Continued use of the Service after such changes become effective constitutes acceptance of the updated Terms.
